In a significant legal settlement, DoorDash agrees to pay nearly $17 million to resolve allegations concerning the improper use of customer tips to subsidize the wages of its delivery drivers, known as Dashers, in New York. This settlement comes in response to an investigation led by Attorney General Letitia James, which uncovered that between May 2017 and September 2019, DoorDash deceived customers and mismanaged the distribution of tips. The company's compensation structure allowed it to guarantee a base pay for deliveries while using customer tips to reduce its own out-of-pocket expenses. This practice left many Dashers receiving less than they should have, as their earnings depended on tips exceeding the guaranteed amount.
The investigation revealed that DoorDash's pay model obscured the actual destination of customer tips. For instance, if a Dasher was promised a minimum payment of $10 for a delivery and received a $5 tip, DoorDash would only pay the Dasher $5, effectively pocketing the tip. Attorney General James criticized this approach as "fundamentally unfair," emphasizing that it misled customers into believing that their contributions were going directly to the workers. The settlement not only aims to provide restitution to the affected Dashers, with individual payments potentially reaching up to $14,000, but also highlights the growing scrutiny of gig economy practices and the need for transparent payment structures.
