Toyota Motor's Attempt to Resolve Class Action Lawsuit Over Forklift Emissions
Toyota Industries Corporation and its subsidiaries face a proposed class action settlement regarding allegations of improper emissions certification for certain internal combustion (IC) forklifts sold in the U.S. The case, Broadmoor Lumber & Plywood Co., et al. v. Toyota Industries Corp., et al., which is pending in the U.S. District Court for the Northern District of California, challenges the emissions compliance of forklifts manufactured between 2007 and 2021. The plaintiffs maintain that the company failed to adhere to proper emissions standards, potentially misleading customers and violating environmental regulations. Despite Toyota denying any wrongdoing, the decision to settle aims to provide resolution and prevent a prolonged legal dispute.
The proposed settlement class includes all individuals and entities that purchased or leased the affected forklifts through January 20, 2026. As part of the agreement, settlement class members may receive cash payments as well as additional benefits, such as a service plan visit for maintenance and a warranty for new parts should a recall necessitate repairs. Claimants must submit a Claim Form by September 22, 2026, to qualify for these benefits, while those wishing to opt out of the settlement have until June 1, 2026, to do so. However, choosing to exclude oneself from the agreement will result in forfeiting any potential financial compensation or warranty benefits provided by the settlement.
